RE: The tariff classification of a non-vacuum beverage container, a metal game carrier, an ankle band, and a can holder from China

Dear Ms. Deich:

In your letter dated March 20, 2006, you requested a tariff classification ruling.

The submitted samples are a non-vacuum beverage container, a metal game carrier, an ankle band, and a can holder. The beverage container is made out of stainless steel and measures approximately 12” tall x 3” in diameter. It is covered in a polyurethane-coated neoprene fabric. The item features a webbed carrying strap.

The applicable subheading for the beverage container will be 7323.93.0080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for a table, kitchen or other household articles and parts thereof, of iron or steel, other, of stainless steel, other. The rate of duty will be 2% ad valorem.

The metal game carrier is constructed of two black metal hooks attached to the ends of a polyurethane-coated neoprene strap with webbing and an attached plastic fastening hook. The item measures approximately 32½”L x 2½”W.

The applicable subheading for the metal game carrier will be 9507.90.8000, HTSUS, which provides for fishing rods, fish hooks, and other line fishing tackle; fish landing nets, butterfly nets, and similar nets, decoy “birds” (other than those of heading 9208 or 9705) and similar hunting or shooting equipment, parts and accessories thereof: other, including parts and accessories. The duty rate will be 9% ad valorem.

The ankle band measures approximately 15”L x 1¼”W and is constructed of polyurethane-coated neoprene with a hook-and-loop fastener. We assume that the textile-covered neoprene weighs less than 1500 grams per square meter, in which case it is a textile fabric according to Chapter 59, Note (4)(i), HTSUS.

The can holder measures approximately 4”W x 4”H. It is constructed of polyurethane-coated neoprene; again, we assume this fabric is textile.

The applicable subheading for the ankle band and the can holder will be 6307.90.9889, HTSUS, which provides for other made up textile articles, other. The duty rate will be 7% ad valorem.

The samples will be returned as requested. We have retained one ankle strap with our file as an official sample.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
