RE: The tariff classification of woman’s pullover from China

Dear Ms. Boullet:

In your letter dated March 27, 2006, you requested a classification ruling. Your sample and components are being returned as requested.

The submitted sample, style number AL2209, is a woman’s pullover that is constructed from 100% cotton jersey knit fabric (portions of the front and back panels) and 3x2 rib knit fabric (portions of the front and back panels, the sleeves, the bottom). The outer surface of the fabrics measures more than 9 stitches but less than 18 stitches per 2 centimeters in the direction that the stitches were formed. The stitch count does not reflect the purl stitches of the ribbed fabric. The pullover features a round neckline, long sleeves, and a self-start bottom. A fabric “Columbia” label is on the left sleeve at the cuff. The pullover is knit to shape and meets the requirements of Statistical Note 6, Chapter 61, Harmonized Tariff Schedule of the United States (HTSUS).

The applicable subheading for the pullover will be 6110.20.2077, HTSUS, which provides for pullovers, knitted: of cotton: otherother: women’s. The duty rate will be 16.5% ad valorem.

The pullover falls within textile category designation 339. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
