RE: The tariff classification of a women’s knit jacket from China.

Dear Ms. Park:

In your letter dated February 28, 2006, you requested a classification ruling.

You submitted a sample of a jacket that will be returned as you have requested.

Style E467048 is a women’s jacket made of 60% cotton and 40% acrylic knit fabric whose outer surface measures more than 9 stitches per 2 centimeters in the horizontal direction. The garment features a full front zippered opening, a mock turtleneck collar, front pockets, ribbed cuffs and a close fitting ribbed waistband.

You suggested that the jacket be classified as a cardigan, knit to shape, under heading 6110, Harmonized Tariff Schedule of the United States (HTSUS). Style 128168-FA ’06, with its tight fitting cuffs and waistband, is more accurately classified as a jacket.

The applicable subheading for style E467048 will be 6102.20.0010, HTSUS, which provides for Women’s or girls’ overcoatswindbreakers and similar articles, knitted or crocheted, other than those of heading 6104: Of cotton: Women’s. The duty rate will be 15.9% ad valorem.
