RE: The tariff classification of a women’s knit pullover from China.

Dear Ms. Park:

In your letter dated February 28, 2006, you requested a classification ruling.

You submitted a sample of a pullover that will be returned as you have requested.

Style F956484 is a women’s pullover made of 71% rayon, 27% nylon and 2% metallic knit fabric whose outer surface measures more than 9 stitches per 2 centimeters in the horizontal direction. For purposes of Statistical Note 6 to Chapter 61, the outer surface of the fabric measures more than 9 but equal to or less than 18 stitches measured in the direction in which the stitches were formed. The garment features a banded v neckline, long sleeves with rib knit cuffs which transition into jersey fabric and a rib knit waistband that also transitions into jersey knit fabric.

All the component pieces of the garment that you submitted meet the knit to shape requirements of statistical note 6 to chapter 61. The garment is linked and looped together.

The applicable subheading for style F956484 will be 6110.30.3057, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for Sweaters, pulloversand similar articles, knitted or crocheted: Of man-made fibers: Other: Other: Other: Other: Other: Women’s or girls’: Knit to shape articles described in statistical note 6 to this chapter. The duty rate will be 32% ad valorem.
