RE: The tariff classification of mitts from China.

Dear Ms. Tsiavos:

In your letter dated February 22, 2006, you requested a classification ruling.

Two samples were submitted for review. Style “8114 Black Lace” is a mitt measuring approximately 12-1/2 inches in length that is constructed of a 90% polyester 10% spandex lace-like fabric. The fingerless item features a thumbhole along the side seam of the hand, two rows of 8 grommets down the glove backside that are laced with a ribbon tie, and a hemmed top and bottom. The mitt will also be available in a 100% polyester knit cut pile fabric as Style “8114 Black Velvet”.

The applicable subheading for both styles will be 6116.93.8800, HTSUS, which provides for Gloves, mittens and mitts, knitted or crocheted: other: of synthetic fibers: other: other: without fourchettes. The rate of duty will be 18.6 percent ad valorem.

Both styles fall within textile category designation 631. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
