RE: The tariff classification of a men’s jacket from Vietnam

Dear Mr. D’Andrea:

In your letter dated February 21, 2006, on behalf of Rennoc Corporation, you requested a classification ruling. A sample was submitted and is being returned as you requested.

The item in question, style #633, is a men’s outerwear pullover jacket with a shell made from a woven 100% polyester fabric with an acrylic coating for water resistance. The garment has a crossover V-neck opening trimmed with a rib knit fabric, long sleeves with elasticized ends, a jersey knit lining in the body and a taffeta lining in the sleeves slant pockets at the waist, a yoke-style back over a mesh fabric and a tunneled elastic drawstring at the bottom hem.

Although you attached a copy of a report from a testing laboratory with your letter, the report indicates that AATCC Method 127 was used. Please note that the tariff requires testing in accordance with AATCC Method 35. Notwithstanding this fact, the garment may be eligible for classification as water resistant.

If meeting the requirements for water resistance when tested in accordance with the requirements of Chapter 62 Additional U.S. Legal Note 2, the applicable subheading for the jacket will be 6201.93.3000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other men’s or boys’ anoraks (including ski-jackets), windbreakers and similar articles, of man-made fibers, water resistant. The duty rate will be 7.1 percent ad valorem.

If not meeting the requirements for water resistance in accordance with the requirements of Chapter 62 Additional U.S. Legal Note 2, the applicable subheading for the jacket will be 6201.93.3511, Harmonized Tariff Schedule of the United States (HTSUS), which provides for which provides for other men’s anoraks (including ski-jackets), windbreakers and similar articles, of man-made fibers. The duty rate will be 27.7 percent ad valorem.

This jacket falls within textile category designation 634. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
