RE: The tariff classification of a woven polypropylene textile fabric, coated with polypropylene plastics, from China.

Dear Mr. Hannan:

In your letter dated March 21, 2006, on behalf of Cast Products, Elkhart, IN, you requested a classification ruling. The supplier is identified as Intertape Polymer Group, China.

A data sheet submitted with your inquiry indicates that two possible colors, a gray and a black, may be imported. This letter will address the black sample, which was submitted with your letter. This style, identified as RV 25(23) PP, consists of a woven fabric constructed from polypropylene plastic strips, which measure under 5 mm in apparent width, and, as such, are considered to be textile for tariff purposes. This material has been visibly coated on one side with a compact polypropylene plastics material. You state that this material has the following composition, by weight:

Wt. Of PP fabric: 133 g/m² (72%)
Wt. Of PP coating: 52 g/m² (28%)
Total Wt.: 185 g/m²

The applicable subheading for the material, which will be imported as roll goods, will be 5903.90.2500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for textile fabrics laminated with plastics, of man-made fibers, not over 70 percent by weight of plastic. The duty rate will be 7.5 percent ad valorem.      

This merchandise falls within textile category designation 229. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
