RE: The tariff classification of a woman’s pullover and a cardigan from China

Dear Mr. Delbyck:

In your letter dated March 13, 2006, you requested a classification ruling on behalf of Portway International Limited. As requested, your sample is being returned to you.

Style GL361023 is a woman’s cardigan constructed from 65% rayon, 35% nylon knit fabric. The outer surface of the garment measures more than nine stitches per two centimeters in the direction in which the stitches were formed. The garment features a V-shaped neckline, a full front opening with one button closure, and ¾ length sleeves. The garment has insufficient lines of demarcation on the front panel. Therefore, it does not meet the requirements of statistical note 6 to chapter 61, Harmonized Tariff Schedule of the United States, (HTSUS).

Style GL361024 is a woman’s pullover constructed from 65% rayon, 35% nylon knit fabric. The outer surface of the garment measures more than nine stitches per two centimeters in the direction in which the stitches were formed. The garment features a square neckline and sleeveless armholes. The garment has insufficient lines of demarcation on the front and back panel. In addition, the trim does not have lines of demarcation. Therefore, it does not meet the requirements of statistical note 6 to chapter 61, HTSUS.

The applicable subheading for styles GL361023 and GL361024 will be 6110.30.3059, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: other: other: other: other: other: women’s: other. The duty rate will be 32% ad valorem.

Tariff number 6110.30.3059 falls within textile category designation 639. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
