RE: The tariff classification of a woman’s pullover from China

Dear Ms. McGrenahn:

In your letter dated March 16, 2006, you requested a classification ruling.

The submitted sample, style number 400704CB, is a woman’s pullover that is constructed from 100% cotton 2x2 rib knit fabric. The outer surface of the garment measures more than 9 stitches but less than 18 stitches per 2 centimeters in the horizontal direction. The stitch count does not reflect the purl stitches of the fabric. The pullover features a round neckline, long sleeves, and a self-start bottom. The neckband, a component, is not knit to shape. The garment does not meet the requirements of Statistical Note 6, Chapter 61, Harmonized Tariff Schedule of the United States (HTSUS).

The applicable subheading for the pullover will be 6110.20.2079, HTSUS, which provides for pullovers, knitted: of cotton: otherother: women’s. The duty rate will be 16.5% ad valorem.
