RE: The tariff classification of infants’ wear from China

Dear Ms. Rucki:

In your letter dated March 13, 2006 you requested a classification ruling.

Submitted style S2847, is comprised of two parts, marketed together on a plastic hanger. One of the parts, manufactured from finely knitted fabric of 100% cotton, is a pair of pajamas, the long-legged bottoms of which are fully elasticized around the waistband and the upper body portion of which is characterized by long sleeves, a hood, and a full-front, snapped opening. The other of these parts is a pair of booties, manufactured from finely knitted fabric of 100% cotton, and packaged in a cardboard-headed, plastic bag that is stapled to the upper body garment.

The applicable subheading for the this style will be 6111.20.6030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for babies’ garments and clothing accessories, knitted, of cotton, other, other, other, other. The duty rate will be 8.1 percent ad valorem.
