RE: The tariff classification of a woman’s pullover from China. Correction to Ruling Number M81580

Dear Mr. Caldwell:

This replaces Ruling Number M81580, dated March 7, 2006. In your letter, dated March 16, 2006, you state that the manufacturing process of style 8633 has been modified. A complete corrected ruling follows.

You submitted the modified sample of a women’s knit pullover identified by style number 8633. The component pieces of the modified garment were also submitted. Your samples will be returned as you have requested.

Style 8633 is a woman’s knit pullover featuring short sleeves and a V-shape neckline in which the V is shaped by a wooden ring covered by the neckline fabric. The rib knit fabric, constructed of 70% rayon and 30% nylon, measures more than 9 stitches per 2 centimeters counted in the horizontal direction. For purposes of Statistical Note 6 to Chapter 61, the stitch count is more than 9 but equal to or less than 18 stitches per 2 centimeters measured on the outer surface of the fabric in the direction in which the stitches were formed. All of the components are considered knit to shape and all are linked and looped together.

The applicable subheading for style 8633 will be 6110.30.3057, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, cardigansand similar articles, knitted or crocheted: Of man-made fibers: Other: Other: Other: Other: Other: Women’s or girls’: Knit to shape articles described in statistical note 6 to chapter 61. The duty rate will be 32% ad valorem.
