RE: The tariff classification of Mine-X Sootfilters from Canada

Dear Ms. Sugar:

In your letter dated February 28, 2006 you requested a tariff classification ruling on behalf of your client DCL International Incorporated.

The “Mine-X Sootfilters” is the brand name for DCL diesel particulate filters used to reduce diesel particulate matter and diesel fumes from diesel engine exhaust emissions. They have a catalytically-coated ceramic monolith, which contains long narrow channels open on one end and blocked at the other. The exhaust gas is forced to escape by passing through the filter walls, trapping particulate matter (soot) in the filter. At a high exhaust gas temperature the soot particles burn away and transform into harmless carbon dioxide. The diesel oxidation catalyst (DOC) is effective for the control of carbon monoxide (CO), hydrocarbons (HC), odor causing compounds, and the soluble organic fraction (SOF) of particulate matter meeting the Environmental Protection Agency (EPA) and California Air Resources Board (CARB) standards for particulate emissions in diesel vehicle retrofits, or simply to improve the air quality in a work site containing diesel engines. DCL's diesel particulate filters are used to meet Mine Safety and Health Administration (MSHA) standards for particulate matter in underground mines.

The applicable subheading for the “Mine-X Sootfilters” will be 8421.39.4000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Centrifuges, including centrifugal dryers; filtering or purifying machinery and apparatus, for liquids or gases; parts thereof: Filtering or purifying machinery and apparatus for gases: Other: Catalytic converters. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
