RE: The tariff classification of the Snow White and Friends Snowglobe from China

Dear Mr. Maher:

In your letter dated March 7, 2006, on behalf of Hoop Retail Store, you requested a tariff classification ruling. You have submitted a sample of the Snow White and Friends Snowglobe with your ruling request.

Item number V 1047X0002 for which you are requesting a ruling is identified as the Snow White and Friends Snowglobe. The submitted sample consists of a snowglobe with a wind up music box in the base of the snowglobe. The item measures approximately 7 inches in height by 7 inches in width by 6 inches in depth. Inside the snowglobe is a three-dimensional figurine of Snow White in a seated position. Snow White is touching a rabbit with her right hand and a deer with her left hand. Situated around the base, outside of the snowglobe, are various birds and animals, flowers and a tree. The wind up music box plays the tune of “Brahms Waltz”.

Your sample is being returned as requested.

The applicable subheading for the Snow White and Friends Snowglobe will be 9208.10.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for music boxes, fairground organs, mechanical street organs, mechanical singing birds, musical saws and other musical instruments not falling within any other heading of this chapter; music boxes. The rate of duty will be 3.2 percent ad valorem.

Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
