RE: The tariff classification of a pullover from China

Dear Ms. Fox:

In your letter dated March 6, 2006, you requested a classification ruling on behalf of Jones Apparel Group.

A sample identified as style WDTA13408 was submitted, along with its component parts. The garment is a cap sleeved round neck pullover, made of 100% cotton. The outer surface of the garment measures more than 9 but equal to or less than 18 stitches per 2 centimeters in the direction in which the stitches were formed. The component pieces are all knit to shape in accordance with the requirements of statistical note 6 to chapter 61, Harmonized Tariff Schedule of the United States, (HTSUS). The sample garment and components will be returned as you have requested.

The applicable subheading for style WDTA13408 will be 6110.20.2077, HTSUS, which provides for sweaters, pulloversand similar articles, knitted or crocheted: Of cotton: Other: Other: Other: Women’s or girls’: Knit to shape articles described in statistical note 6 to this chapter. The duty rate will be 16.5% ad valorem.
