RE: The tariff classification of costume from China.

Dear Ms. Lin

In your letter dated received by this office on March 3, 2006, you requested a classification ruling.

Your submitted sample, Item SW1070 is a child’s size Halloween Plush Cat Costume. The well-made costume consists of a one-piece hooded jumpsuit constructed of knit plush 80% polyester and 20% acrylic fiber fabric. The hood is stuffed to look like a cat. The garment has styling features, a well-made neck and waist, well-made seams, a zippered partial front closure, elasticized hood opening, finished arm, ankle, closure and hood edges.

The applicable subheading for Item SW1070 will be 6114.30.3054, Harmonized Tariff Schedule of the United States (HTSUS), which provides for provides for other garments, knitted or crocheted: of man-made fibers: other, coveralls, jumpsuits and similar apparel: women’s or girls’: other. The duty rate will be 14.9 percent ad valorem.

Item SW1070 falls within textile category designation 659. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
