RE: The tariff classification of costume from China.

Dear Ms. Lin

In your letter received by this office on March 3, 2006, you requested a classification ruling.

Your submitted sample, Item SW1033-1 is a child’s Halloween Fairy Costume consisting of a dress. You state the dress is made of polyester knit construction. However, the skirt portion of the dress is made of three layers, of which only the top two layers are made of knit net fabric; the top portion of the dress and bottom layer of the skirt portion of the dress are made of polyester woven fabric. The dress has styling features, including attached wings, well-made neck, waist and seams, finished arm straps and edges, and sewn on embellishments. The woven portion of the dress imparts the essential character.

The applicable subheading for Item SW1033-1 will be 6204.43.4040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, . . . dresses: of synthetic fibers: other; other, other: girls’. The duty rate will be 16 percent ad valorem.

Item SW1033-1 falls within textile category designation 636. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
