RE: The tariff classification of a boy’s printed pullover from China

Dear Ms. Park:

This ruling replaces NY M81703, dated March 17, 2006, which contained a technical evaluation of the sweat patch feature that has since been revised. A corrected ruling follows.

Submitted style E207130/EK207130/ET207130/”Bedlam”, manufactured from jersey fabric of 100% cotton, is a long-sleeved pullover, the cuffs, waistband, and round neckline of which are rib-knitted. The garment components are knit to shape on a flat-bed knitting machine and have a stitch count on their outer surface of between 10 and 18 stitches per two centimeters. A linking and looping process assembles the components.

The applicable subheading for this style will be 6110.20.2067, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers and similar articles, knitted or crocheted, of cotton, other, other, men’s or boys’: knit to shape articles described in statistical note 6 to this chapter. The duty rate will be 16.5 percent ad valorem.
