RE: The tariff classification of prepackaged replacement ribbons from Japan

Dear Ms. Pearsall:

In your letter dated March 2, 2006 you requested a tariff classification ruling on behalf of your client, DNP IMS America Corporation.

You request a ruling for the prepackaged replacement ribbons for the “Datacard” printer system. The ribbons are on spools designed specifically for the SP35 and SP55 SP series card printers. The ribbons have radio frequency technology that enables them to communicate to the printer which ribbon has been inserted. It provides the printers with adjustments to automated color and image density, ribbon usage tracking and ribbon conservation. The SP35 and SP55 card printers are thermal transfer printers that connect to a computer. They print an inline topcoat for clear or holographic laminate in addition to the base colors: yellow, magenta, cyan, and black. The printers meet Chapter 84, Note 5 (D) and are classified under subheading 8471.60.

The applicable subheading for the prepackaged replacement ribbons will be 8473.30.5000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Parts and accessoriessuitable for use solely or principally with machines of headings 8469 to 8472: Parts and accessories of the machines of heading 8471: Not incorporating a cathode ray tube: Other.” The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
