RE: The tariff classification of magnetic sign from China

Dear Ms. Marcoux:

In your letter, dated March 8, 2006, you requested a tariff classification ruling.

The merchandise is a stainless steel plate with a magnetic back, called a “Measurement Equivalent Magnet.” There are three styles, each etched on its surface with a different group of measuring equivalents: liquid measurements (item number 54320), weight measurements (item number 54322), and dry measurements (item number 54324). The literature you provided indicates that they adhere to metal surfaces in the kitchen and that their purpose is to take the guesswork out of measuring conversions when cooking or baking. Each measures approximately 5 3/8 inches long by 4 5/8 inches wide.

The applicable subheading for the base metal sign plates will be 8310.00.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sign plates, name plates, address plates and similar plates, numbers, letters and other symbols, and parts thereof, of base metal, excluding those of heading 9405. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
