RE: The tariff classification of a woman’s blouse from China

Dear Ms. Gong:

In your letter dated February 2, 2006, you requested a tariff classification ruling on behalf of Norton. The submitted sample will be returned to you as requested.

Style FNMR15 is a woman’s blouse constructed from 100 percent cotton woven fabric. The blouse extends to the hips and features a V-neckline, an empire waist, shoulder straps that measure 3 ½ inches wide, a side zipper opening and a lining. The garment is embellished with beading.

You have suggested classifying this garment under subheading 6211.42.0056, HTSUS, which provides for other blouses such as sleeveless tank styles. Although this garment is sleeveless, it lacks the silhouette of a tank style garment. In addition, the garment has sufficient shoulder coverage to be considered a blouse in the more specific heading of 6206.

The applicable subheading for the blouse will be 6206.30.3040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ blouses, shirts and shirt-blouses: of cotton: other: other: with two or more colors in the warp and/or the filling: women’s. The duty rate will be 15.4 percent ad valorem.
