RE: The tariff classification of a men’s knit pullover garment from China.

Dear Ms. Hilton:

In your letter dated March 1, 2006, you requested a tariff classification ruling on behalf of Bamboo Textiles, Brea, CA 92821. Your response was delayed due to laboratory analysis. As requested, your samples will be returned.

Style 200 is a men’s pullover garment constructed from a heavy weight, jersey knit fabric that measures 20 stitches per two centimeters counted in the horizontal direction. The garment has a rib knit crew neckline; short, hemmed sleeves, and a straight, hemmed bottom. The fabric weight is more than 200 grams per square meter.

In your correspondence, you state that the bamboo used to make the fabric of Style 200 is processed using a mechanical method rather than a chemical method. Laboratory analysis has found that the fabric is composed of 71.6% regenerated cellulose fiber and 28.4% cotton. Regenerated cellulose fiber is considered an artificial fiber.

Consequently, the applicable subheading for Style 200 will be 6110.30.3053, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: other: other: other: other: men’s or boys’: other. The rate of duty is 32% ad valorem.

Style 200 falls within textile category designation 638. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
