RE: The tariff classification of a costume from China.

Dear Mr. Williams:

In your letter dated February 7, 2006, you requested a tariff classification ruling.

You submitted the following textile costume, which meets the flimsy, non-durable requirements for classification within Chapter 95 and is being returned upon your request.

Style 82930, Edgy Esmarelda, is a textile costume set that consists of a polyester knit velveteen purple dress, a black top and hat made of polyurethane with polyester backing, a belt, and sleeves, with the dress imparting the essential character. Although the dress has a well-made styling feature (bust line) and a well-made embellishment (tape in front), it has flimsy construction of the neck, waist and seams, a flimsy hook and loop tab closure and flimsy edges at the hem and closure.

The applicable subheading for style 82930, Edgy Esmarelda, will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other." The rate of duty will be Free.
