RE: The tariff classification of a woman’s shirt and skirt from China.

Dear Mr. Gui:

In your letter, received on February 14, 2006, you requested a classification ruling for a woman’s shirt, skirt and pullover. As requested, the submitted samples will be returned.

Style 3P58C is a woman’s skirt constructed from 65 percent rayon, 35 percent nylon rib knit fabric. The skirt fully lined skirt has a covered elasticized waistband and a self-finished bottom.

Style 5P58A is a woman’s shirt constructed from 65 percent rayon, 35 percent nylon rib knit fabric with more than ten stitches per centimeter in both the horizontal and vertical directions. The shirt has a full front opening with a button closure, long sleeves, and a self-finished bottom.

For style 3P58B we are returning your request for a classification ruling and any related samples, exhibits, etc., because we need additional information in order to issue a ruling. Because the garment is claimed to be “knit to shape” in accordance with Chapter 61, statistical note 6, provide all of the component pieces as they come off the knitting machine.

Because style 5P58A is classified in heading 6106, the exemption for non-quota items that you suggested, which is found at the statistical level within heading 6110, is not applicable.

The applicable subheading for style 3P58C will be 6104.53.2010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Women’sskirts, knitted or crocheted: Of man-made fibers. The duty rate will be 16% ad valorem.

The applicable subheading for style 5P58A will be 6106.20.2010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Women’s and girls’ blouses and shirts, knitted or crocheted: Of man-made fibers. The duty rate will be 32% ad valorem.

Style 3P58C falls within textile category designation 642; style 5P58A falls within textile category designation 639. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
