RE: The tariff classification of scrimmage vests from China.

Dear Mr. Erickson:

In your letter dated February 6, 2006 on behalf of Dick Martin Sports, Inc. (“Martin Sports”), you requested a classification ruling. The samples will be returned to you as requested.

Two samples of soccer scrimmage vests were submitted with your request. Style SVA2, scrimmage vest is made of mesh knit 100% polyester fabric. Style P1, scrimmage vest is made of woven 100% polyester fabric. Both items extend from the neck and shoulders to below the waist, have a large rounded neckline and oversized armhole openings that extend nearly to the waist. All edges are hemmed. Both items is designed to identify and distinguish one team from another.

The applicable subheading for the scrimmage vest, style SVA2 will be 6117.80.9540, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Other made up clothing accessories, knitted or crocheted; knitted or crocheted parts of garments or of clothing accessories: Other accessories: Other: Other...Of man-made fibers: Other." The duty rate will be 14.6% ad valorem. The textile category designation is 659.

  The applicable subheading for the scrimmage vest, style P1 will be 6217.10.9530, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Other made up clothing accessories; parts of garments or of clothing accessories, other than those of heading 6212: Accessories: Other: Other...Of man-made fibers." The duty rate will be 14.6% ad valorem.  The textile category designation is 659.
