RE: The tariff classification of a blanket and stuffed toy from China

Dear Ms. Lasanske:

In your letter dated February 13, 2006 you requested a classification ruling.

You submitted a sample of an infant’s blanket and a stuffed teddy bear rattle referred to as “The Pocketoo Coveroo.” The blanket measures approximately 30 x 26 inches. One side is made from 100 percent cotton woven tufted fabric, which is sometimes referred to as chenille. The other side is made from a knit fleece fabric stated to be a polyester blend. For the purposes of this ruling it is assumed that the fleece fabric is in chief weight polyester. The two fabrics are sewn together along their edges. The fleece side is embroidered and features an 8.5 x 5.5 inch pocket that will hold the teddy bear rattle. The bear is approximately 7 inches tall and is made from a polyester pile fabric. It is stuffed with polyester fiber and contains a plastic rattle. Although packaged together at time of import, the blanket and bear/rattle are not considered “goods put up in sets for retail sale.”

The applicable subheading for the blanket will be 6301.40.0020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for blankets and traveling rugs: blankets (other than electric blankets) and traveling rugs, of synthetic fibers other. The duty rate will be 8.5 percent ad valorem.

The applicable subheading for the teddy bear rattle will be 9503.41.0000, HTSUS, which provides for toys representing animals or non-human creatures (for example, robots and monsters) and parts and accessories thereof: stuffed toys and parts and accessories thereof. The duty rate will be Free.

The blanket falls within textile category designation 666. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
