RE: The tariff classification of a woman’s halter-top from Hong Kong

Dear Ms. De Silva:

In your letter dated February 7, 2006, you requested a classification ruling. The submitted sample will be returned to you as requested.

Style PP 299612 is a woman’s halter-top constructed from 100 percent rayon woven fabric. The garment features a V-neckline, straps that fasten at the nape of the neck, an empire waist and a smocked upper back. The neckline, waist and straps are embellished with sequins and decorative stitching. The garment does not provide sufficient coverage of the shoulders and upper back.

The applicable subheading for the halter-top will be 6211.43.0091, Harmonized Tariff Schedule of the United States (HTSUS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of man-made fibers: other. The duty rate will be 16 percent ad valorem.
