Dear Mr. Kamnitz:

In your letter dated February 1, 2006, you requested a classification ruling on behalf of Ralsey Group Ltd.

You submitted three samples of women’s pullovers, all made of 100% acrylic fiber. All of the garments have surfaces of fabric that measure more than 9 but equal to or less than 18 stitches per 2 centimeters in the direction in which the stitches were formed. The garments all have long sleeves with rib knit cuffs, and rib knit bottoms. The garments’ sleeves and body panels have self start bottoms, and self finished sides. There are full fashion marks around the armholes of the garments, on both the sleeves and the front and back panels. All the seams are looped and linked together; the collars are looped and linked to the garment bodies. The only substantial visual difference in these garments is in the collar treatment. Style 7725 features a long cowl collar, style 7744 features a short cowl collar, and style 7749 features a short cowl collar incorporated into a v shaped neckline. Your samples are being returned as you have requested.

The applicable subheading for styles 7725, 7744, and 7749 will be 6110.30.3057, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pulloversand similar articles, knitted or crocheted: Of man-made fibers: Other: Other: Other: Other: Other: Women’s or girls’: Knit to shape articles described in statistical note 6 to this chapter. The duty rate will be 32% ad valorem.
