RE: The tariff classification of a magazine rack from China

Dear Mr. Mr. Hoffacker:

In your letter dated January 25, 2006, on behalf of At Home America, you requested a tariff classification ruling.

The merchandise is a black, wall-mounted, magazine rack with a chalkboard attached at the top (item number 39000222). The rack is made of steel wire with a wooden base. The chalkboard measures about 11 inches wide by 7 inches high. The entire rack is approximately 20 inches in height and 12 inches in width. The pocket for holding magazines is 9 inches high and 4 inches deep.

The applicable subheading for the magazine rack will be 7323.99.9060, Harmonized Tariff Schedule of the United States (HTS), which provides for table, kitchen or other household articles and parts thereof, of iron or steel, other, other, not coated or plated with precious metal, other, other, other. The rate of duty will be 3.4 percent ad valorem.
