RE: The tariff classification of safety vest from China.

Dear Mr. Forman:

In your letter dated, January 20, 2006, you requested a classification ruling.

Your submitted sample is a man’s safety vest constructed of a woven 100% polyester fiber fabric. The over-sized item features a full frontal opening fastened with a left over right five snap closure, deep V-neckline, self capping around the oversized armholes, neckline, frontal opening and bottom. The safety vest also has an approximately 1½ inch wide strip of reflective tap sewn horizontally around the back and front of the item right below the armholes. The item is used over clothing as a warning for oncoming traffic etc., and provides safety to the wearer.

The applicable subheading for the safety vest will be 6217.10.9530, Harmonized Tariff Schedule of the United States (HTS), which provides other made up clothing accessories, parts of garments or of clothing accessories, other than those of heading 6212: accessories: other: other, of man-made fibers. The duty rate will be 14.6 percent ad valorem.

The safety vest falls within textile category designation 659. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
