RE: The tariff classification of shopping type open top tote bags, a suit bag, a shoe bag and boot bag from China

Dear Ms. Baste:

In your letter dated January 13, 2006, you requested a classification ruling. The request is on behalf of Punto Fa S.L.

The submitted samples are identified as styles 070675, 070676 and 070677, shopping type open top tote bags and style 070672, suit bag, 070673, shoe bag, and 070674, boot bag. Each style is a carrying bag wholly manufactured of man-made fiber textile materials. The bags are designed and used to provide storage, protection, organization and portability for clothing or other personal effects during travel. Each bag is designed for repetitive re-use subsequent to their initial use as a container for the personal effect with which they may be sold.

The applicable subheading for the carrying bags of man-made fiber textile materials will be 4202.92.3031, Harmonized Tariff Schedule of the United States (HTSUS), which provides for travel, sport and similar bags, with outer surface of textile materials, of man-made fibers. The duty rate will be 17.6 percent ad valorem.

4204.92.3031 falls within textile category designation 670. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
