RE: The tariff classification of a woman’s vest from China

Dear Ms. Lam:

In your letter dated January 20, 2006, you requested a classification ruling. Your sample is being returned as requested.

The submitted sample, style number 9022, is a woman’s sleeveless vest that is constructed from 73% acrylic, 23% nylon, 4% spandex, knit fabric. The vest features a deep V-neckline, oversized armholes, and a ribbed bottom. The neckline and armholes are finished with ribbed fabric.

The applicable subheading for the vest will be 6110.30.3035, Harmonized Tariff Schedule of the United States (HTSUS), which provides for vests, knitted: of man made fibers: otherother: vests, other than sweater vests: women’s. The duty rate will be 32% ad valorem.

The vest falls within textile category designation 659. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
