RE: The tariff classification of a woman’s suit-type jacket from China

Dear Mr. Schoenig:

In your letter dated January 24, 2006, on behalf of BCTC Corp., 5901 South Eastern Avenue, City of Commerce, California 90040, you requested a classification ruling. Your sample is being returned as requested.

The submitted sample, style number WS512115, is a woman’s tailored suit-type jacket that is constructed from 100% cotton, knit fabric. The garment has more than 3 panels sewn together lengthwise and features the following: a notched-lapel collar, long hemmed sleeves, a full front opening with a 4-button closure, 2 front patch pockets in the waist area, princess seams, a 2-button adjustable strap on the lower back, and a hemmed bottom.

The applicable subheading for the suit-type jacket will be 6104.32.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s suit-type jackets, knitted: of cotton. The duty rate will be 54.8 cents/kg + 16% ad valorem.

The suit-type jacket falls within textile category designation 335. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
