RE: The tariff classification of a woman’s knit top from Taiwan.

Dear Mr. Treppiedi:

In your letter dated January 23, 2006, you requested a classification ruling for a woman’s knit crop top.

The submitted sample, Style #2947, is a woman’s top constructed from 55% cotton, and 35% polyester, and 10% spandex knit fabric. The sleeveless garment features a modified V-shaped neckline in front, shoulder straps, a gathered front at the chest area, and an elasticized bottom. The garment extends just below the bust.

We are returning your sample as you requested.

The applicable subheading for Style 2947 will be 6114.20.0010 Harmonized Tariff Schedule of the United States (HTSUS), which provides for other garments, knitted or crocheted of cotton, tops, women’s or girls’. The rate of duty will be 10.8% ad valorem.

Style2947 falls within textile category designation 339. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
