RE: The tariff classification of ‘ a “Shower Tote” from China

Dear Ms Roumeliote:

In your letter dated December 16, 2005 you requested a classification ruling.

The submitted sample is identified as item number WSC01013 (UPC 72974 00263 8) “Shower Tote”. The item is an open top tote bag with double self-material handles. The bag has one center storage area and six exterior pockets. The bag is intended to carry sundry toiletries and bath preparations and is designed so that it may be carried into the shower. The sample will be returned as requested.

The applicable subheading for the “Shower Tote”, item WSC010113 will be 4202.92.3031, Harmonized Tariff Schedule of the United States (HTSUS), which provides, in part, for toiletry bags, travel, sport and similar bags, with outer surface of textile materials, of man-made fibers. The duty rate will be 17.6 percent ad valorem.

Tariff number 4202.92.3031 falls within textile category designation 670. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
