RE: The tariff classification of zippered pouches from Hong Kong.

Dear Ms. Quinn:

In your letter dated January 9, 2005, you requested a tariff classification ruling for a set of zippered pouches.

The set is identified as item number 05-1260B and consists of three pouches of the type that have the common use of providing storage, protection, organization and portability for personal effects. You have advised this office that the set will be presented on import packaged for retail sale with a cardboard header and not subject to repacking in the United States. You also advised that the set would be sold at retail as “rack goods.” The set consists of two smaller zippered pouches of man-made textile materials and a larger pouch wholly of a clear polyvinyl chloride (PVC) plastic sheeting. The set will be classified according to General Rule of Interpretation (GRI) 3(b) and the larger pouch imparts the essential character. The sample will be returned as requested.

The applicable subheading for the set of zippered pouches will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports and similar bags, with outer surface of sheeting of plastic, other. The rate of duty will be 20 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
