RE: The tariff classification of a woman’s knit skort from Taiwan.

Dear Ms. Parker:

In your letter dated November 3, 2005, and subsequent telephone conversations, you requested a classification ruling for a woman’s knit skort. The garment will be returned as requested.

Style 0383 is a woman’s knit skort constructed from 88 percent polyester and 12percent spandex knit fabric. The garment is essentially a skirt permanently sewn to a pair of shorts. The garment has an elasticized waistband. The skirt portion has two front pockets, and a plain, hemmed bottom with side slits. The shorts portion has some padding at the crotch and elasticized leg openings.

The applicable subheading for the skort will be 6104.53.2010, Harmonized Tariff Schedule of the United States (HTS), which provides for Women’sskirts and divided skirts knitted or crocheted: Of synthetic fibers. The duty rate will be 16 percent ad valorem.

The skort falls within textile category designation 642. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
