RE: The tariff classification of a “Shoe Tie Practice Board” from China.

Dear Ms. Marcoux:

In your letter dated December 16, 2005, you requested a tariff classification ruling.

You submitted a sample of a “Shoe Tie Practice Board” identified as item number 52760, which is being returned upon your request. The item is an educational toy designed to help a child practice tying their shoes and consists of a pair of multi-colored wooden sneakers that fit into two depressions on a square-shaped wooden board. The sneakers measure approximately 3” in width x 7” in length and have cotton and nylon yellow laces. The board measures approximately 5/8” in height x 11-3/4” in width x 11-3/4” in length, and is decorated with imagery of flowers, a rabbit emerging from its burrow and two snails. A child can practice tying the sneakers on the board or remove the sneakers from the board for additional practice in improving their hand-eye coordination and dexterity.

The applicable subheading for the “Shoe Tie Practice Board” identified as item number 52760 will be 9503.90.0080, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other toys; reduced-size ("scale") models and similar recreational models, working or not; puzzles of all kinds; parts and accessories thereof: Other: Other.”

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
