RE: The tariff classification of a woman’s cardigan from Pakistan

Dear Ms. Chu:

In your letter dated January 3, 2006, you requested a classification ruling.

Style BV-513 was submitted and identified as a jacket. In your letter you state that the garment is made of 100% cotton fiber. The finely knit garment features a hood, a full front zippered opening, a front split kangaroo pocket, sewn on rib knit cuffs and a sewn on rib knit waistband. The loose fitting cuffs and waistband measure over five inches in width. They do not provide any tightness around the wrists or waist. The garment was submitted in a size 2X.

The country of origin “Made in Pakistan”, company name, size, “RN” number and care instructions are all screen printed on the rear neckline of the garment. In your letter you ask if this screen-printing is acceptable marking. The country of origin, “Made in Pakistan” is legibly and conspicuously printed, and satisfies the requirements of Section 304 of the Tariff Act (19 C.F.R. 1304). However, textile fiber products imported into the United States must b labeled in accordance with the Textile Fiber Products Identification Act (15 UCS 70 through 70k) and the rules promulgated thereunder the Federal Trade Commission. Therefore, we suggest you contact the Federal Trade Commission, Division of Enforcement, 6th and Pennsylvania Avenue, Washington, DC 20508 for advice concerning the requirements under this Act. The applicable subheading for style BV-513 will be 6110.20.2079, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pulloversand similar articles, knitted or crocheted: Of cotton: Other: Other: Other: Women’s or girls’: Other. The duty rate will be 16.5% ad valorem.
