RE: The tariff classification of a macaroon mix from Switzerland.

Dear Mr. Forbes:

In your letters dated March 24, 2005 and November 7, 2005, you requested a tariff classification ruling.

Ingredients breakdowns were submitted with your March 24, 2005 letter. The sample submitted with your November letter was forwarded to the US Customs and Border Protection laboratory for analysis. The product, 71372 Coconut Macaroon Mix, imported in 2-kilo bags, is a white powder said to contain 55.32 percent sugar, 38.23 percent coconut, 4.38 percent egg white concentrate, 0.99 percent wheat fiber, and 0.41 percent water. Laboratory analysis found the sample contained 58.37 percent sucrose on a dry weight basis. The mix will be used to make coconut macaroon cookies and biscuits.

The applicable subheading for the 71372 Coconut Macaroon Mix, if imported in quantities that fall within the limits described in additional U.S. note 8 to chapter 17, will be 2106.90.9500 Harmonized Tariff Schedule of the United States (HTSUS), which provides for food preparations not elsewhere specified or includedother other articles containing over 10 percent by dry weight of sugar described in additional U.S. note 3 to chapter 17described in additional U.S. note 8 to chapter 17 and entered pursuant to its provisions. The rate of duty will be 10 percent ad valorem. If the quantitative limits of additional U.S. note 8 to chapter 17 have been reached, this product will be classified in subheading 2106.90.9700, HTSUS, and dutiable at the rate of 28.8 cents per kilogram plus 8.5 percent ad valorem. In addition, products classified in subheading 2106.90.9700, HTSUS, will be subject to additional duties based on their value, as described in subheadings 9904.17.49 to 9904.17.56, HTS
