RE: The tariff classification of printed circuit boards from Taiwan.

Dear Ms. Litman:

In your letter dated March 2, 2005, on behalf of your client Promate Electronic Co., Ltd. you requested a tariff classification ruling.

The items in question are printed circuit driver boards, (samples attached), designed for use with various sized LCD video monitors. They are designated as the E, G and H-series. The video monitors range in screen diagonal from 8.4 inches to 20.1 inches. These printed circuit boards are populated with video processing circuitry, relays and capacitors as well as an inverter present and connected to the boards. They are specially designed to accept and process VGA, NTSC, PAL and composite video signals. They will generate points of light synchronously with the signal source on an LCD display. None of the printed circuit driver boards contain a tuner. This office does not agree with your suggested classification for there is a more specific provision applicable.

The applicable subheading for the printed circuit boards will be 8529.90.0600, Harmonized Tariff Schedule of the United States (HTS), which provides for Parts suitable for use solely or principally with the apparatus of headings 8525 to 8528: Other: Printed circuit assemblies: Of television apparatus: Printed circuit boards and ceramic substrates with components assembled thereon, for color television receivers; subassemblies containing one or more of such boards or substrates, except tuners or convergence assemblies: Other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
