RE: The tariff classification of wooden furniture from France.

Dear Mr. Alfonse:

In your letter dated November 8, 2005, you requested a tariff classification ruling.

The prospective importation consists of contemporary furniture made out of different woods. The furniture items are designed for home or office use and include chairs, loungers, tables (some with glass tops), stools, armoires, TV stands and similar items. The woods used include, maple, galuchat, ash mahogany, ebony of macassar, boxwood, sycamore, amaranth, zebrano, purple wood, and beech wood.

The applicable subheading for wooden furniture (other than seats and tables with glass tops) will be 9403.60.8080, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other furniture and parts thereof: Other wooden furniture: Other, Other.” The rate of duty will be Free.

We are unable to issue a tariff classification ruling on the wooden chairs, stools and tables with glass tops because we need additional information.

Please indicate whether the chairs and stools are upholstered, and whether or not the stools have backs.

Please provide pictures of the table with glass tops as well as cost breakdowns of the component materials.

When this information is available, you can mail your request to U.S. Customs and Border Protection, Customs Information Exchange, 10th Floor, One Penn Plaza, New York, NY 10119, attn: Binding Rulings Section. If your request was submitted electronically and the information required does not involve sending a sample, you can re-submit your request and the additional information electronically.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Lawrence Mushinske at 646-733-3036.

Sincerely,
