RE: The tariff classification of bi-pods and shooting sticks from China

Dear Ms. Schaffer:

In your letter dated October 27, 2005, you requested a tariff classification ruling.

The merchandise to be imported consists of bi-pods: item numbers 40452, 40453, 40454, 40855, 40856, and 40857 and shooting sticks: item numbers 40859, 40860, 40861, 40850, and 40851. All the bi-pods are designed for hunters who need a steady, portable, and versatile rest for the gun while in the field. The shooting sticks are also designed for hunters in the field who require a suitable rest for the gun. Both the bi-pods and the shooting sticks are constructed of aluminum. Pictures were submitted that depict each item.

The applicable subheading for the bi-pods, items 40452, 40453, 40454, 40855, 40856, and 40857 and the shooting sticks, items 40859, 40860, 40861, 40850, and 40851 will be 9305.29.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for parts and accessories of articles of heading 9301 to 9304: of shotguns or rifles of heading 9303: other: other: of rifles: other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
