RE: The tariff classification of latches for motor vehicles

Dear Mr. Forhart:

In your letter, dated October 10, 2005, you requested a tariff classification ruling on behalf of your client, Freightliner LLC.

The merchandise is steel latches used in heavy truck applications. Part number 18-31793-000 is the “Bunk-Latch, Lower”. It is used to secure the sleeper bunk assembly when in use in its lowered position. When not in use, the sleeper bunk is folded up against the back wall of the sleeper cab. When in use, the sleeper bunk rests on the bunk base. The striker hook is located on the underside of the bunk. It coincides with the location of the latch so that it catches and secures the bunk in the lowered position. The latch incorporates a release lever for releasing the latch from the striker hook and allowing the bunk assembly to unlatch from its lowered position.

Part number 50250-3402 is the “Cab Door Latch, LH,” which serves to fasten the door assembly in its closed position by fastening onto the striker pin located in the doorframe post. It is actuated by lock rods within the door assembly when the driver pulls on the door handle.

Part number 47205-3401 is the “Utility Latch/Handle for Latch,” which is used to open and close the toolbox lid. It is a single point paddle handle and latch combination used in a toolbox and battery combination box cover. To open the toolbox lid the driver pulls on the paddle handle, which engages the latch mechanism and lifts the pin that holds onto the striker plate mounted at the bottom of the toolbox. This latch assembly does not include the key lock cylinder. Your letter indicates that the lock cylinder will be imported separately.

The applicable subheading for the latches will be 8302.30.3060, Harmonized Tariff Schedule of the United States (HTS), which provides for base metal mountings, fittings and similar articlesother mountings, fittings and similar articles suitable for motor vehicles; and parts thereof, of iron or steel, of aluminum or of zinc, other. The rate of duty will be 2 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
