RE: The tariff classification of an animal harness, for pulling and dragging large animals, from China.

Dear Mr. Twigger:

In your letter dated October 14, 2005, on behalf of Gauntlet Industries, South Park, PA, you requested a tariff classification ruling.

The subject item, for which you provided a picture and diagram, consists of an animal harness, which is used for pulling and dragging large animals from the woods. In addition, the product is ideal for restraining, moving, lifting and/or pulling living and/or tranquilized animals from parks, wildlife refuges, zoos and similar environments.

Specifically, the harness, itself, is composed of polypropylene webbing straps that are likely woven, having a nylon thread stitching. Also attached, are adjustable plastic snap clips in addition to steel rings. There is also a separate shoulder harness composed of polypropylene webbing having a nylon stitching and a steel ring attached.

The applicable subheading for the harness will be 4201.00.3000, Harmonized Tariff Schedule of the United States (HTS), which provides for saddlery and harness for any animal (including traces, leads, knee pads, muzzles, saddle cloths, saddle bags, dog coats and the like), of any material: dog leashes, collars, muzzles, harnesses and similar dog equipment. The rate of duty will be 2.4 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
