RE: The tariff classification of a video monitor from China.

Dear Ms. Foehner:

In your letter dated September 22, 2005 you requested a tariff classification ruling.

The item in question is a 30” LCD video monitor that does not incorporate any video reproducing or recording apparatus. The video monitor incorporates a Digital Video interface (DVI) and WQXGA display resolution. The Digital Video Interface and the WQXGA display resolution enable the monitor to display video images from DVI enhanced devices. The DVI is designed for high definition digital video from a variety of DVI enhanced devices. Thus a digital video display device with DVI does not require an MPEG decoder for viewing high definition digital video.

You have proposed a classification under HTS heading 8471.60.45 however this office does not agree because this video monitor is not of a class or kind principally or solely used with ADP per Chapter 84, note 5 (B) (a).

The applicable subheading for the LCD video monitor will be 8528.21.7001, Harmonized Tariff Schedule of the United States (HTS), which provides for Reception apparatus for television, whether or not incorporating radiobroadcast receivers or sound or video recording or reproducing apparatus; video monitors and video projectors: Video monitors: Color: With a flat panel screen: Other: Other. The rate of duty will be 5 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
