RE: The tariff classification of a doming punch set and block from India.

Dear Mr. Nuristani:

In your letter, dated August 19, 2005, you requested a tariff classification ruling.

The merchandise, a doming punch set and block, is comprised of 24 punches and a doming block that have been set in a fitted wooden block. The punches and doming block are made of hardened, high carbon steel. The punches have the following sizes in millimeters: 2.3, 3.5, 4.3, 5.1, 5.9, 6.7, 7.5, 8.3, 9.1, 9.9, 10.7, 11.5, 12.3, 13, 13.8, 14.6, 15.4, 16.2, 17, 18.6, 20.2, 21.8, 23.4, and 25. The doming block is a cube measuring 5 cm square and it has 18 circular cut-out holes of varying sizes. The wooden block has slots to accommodate each punch and the doming block. The punches and doming block are jewelry tools used to make spheres of metal.

The applicable subheading for the doming punch set and block will be 8205.59.5560, Harmonized Tariff Schedule of the United States (HTS), which provides for handtools (including glass cutters) not elsewhere specified or included; blow torches and similar self-contained torches; vises, clamps and the like, other than accessories for and parts of machine tools; anvils; portable forges; hand- or pedal-operated grinding wheels with frameworks; base metal parts thereof: other handtools (including glass cutters) and parts thereof: other: other: other: of iron or steel: other: other (including parts). The general rate of duty will be 5.3% ad valorem.

Articles classifiable under subheading 8205.59.5560, HTS, which are products of India, may be entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations. The GSP is subject to modification and periodic suspension, which may affect the status of your transaction at the time of entry for consumption or withdrawal from warehouse. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 CFR).
