RE: The tariff classification of an ECA controller board from Malaysia.

Dear Mr. Chamberlain:

In your letter dated June 17, 2005 you requested a tariff classification ruling.

The item in question is denoted as an ECA controller board, model number stingray 510-1858-XX. It is described as a printed circuit board that is designed for use within a rear projection television receiver. It is employed in the optical engine used to project the television image onto the viewable screen. It is stated that the printed circuit board performs the formatting of the generated image. Also that it controls and synchronizes other functions within the optical engine such as the color wheel, lamp timing and thermal fan control. The board is not a tuner and will not be imported with any of the components enumerated in U.S. Additional Note 4 of Chapter 85.

The applicable subheading for the ECA controller board will be 8529.90.0600, Harmonized Tariff Schedule of the United States (HTS), which provides for Parts suitable for use solely or principally with the apparatus of headings 8525 to 8528: Other: Printed circuit assemblies: Of television apparatus: Other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
