RE: The tariff classification of a disposable cable assembly from China.

Dear Mr. Hamilton:

In your letter dated January 24, 2005 you requested a tariff classification ruling.

The merchandise under consideration is a disposable cable assembly identified as a “Hand Controller” on the submitted literature. This assembly consists of printed circuit board (PCB) with various conductor strips, 2 and 6 conductor PCB connectors, switch, 27” 6-conductor wire with modular RJ11 male connector and crimp splices. In use, the PCB assembly is attached to a medical device for the release of medication. There are two small holes in the PCB used for attaching the Hand Controller onto the medical device. The metal strips on the back of the PCB make contact with a roller in the medical device that completes an electrical connection between the device and the PCB assembly. The Hand Controller is used for one patient only, after the medical procedure is completed, the Hand Controller is discarded preventing any possibility of contamination.

We find that the disposable cable assembly is provided for in heading 8537, Harmonized Tariff Schedule of the United States (HTS), which describes the Hand Controller more specifically than any other heading. This product includes a printed circuit board and two or more apparatus of heading 8536, (i.e., connectors and a switch).

The applicable subheading for the Hand Controller (disposable cable assembly) will be 8537.10.9070, Harmonized Tariff Schedule of the United States (HTS), which provides for “Boards, panels, consoles, desks, cabinets and other bases, equipped with two or more apparatus of heading 8535 or 8536, for electric control or the distribution of electricityFor a voltage not exceeding 1,000 V: Other: Other: Other.” The general rate of duty will be 2.7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
