RE: The tariff classification of a women’s jacket from China

Dear Ms. Iacobello:

In your letter dated November 17, 2005, you requested a tariff classification ruling. The submitted sample will be returned to you as requested.

Style 1BS15R-8066 is a women’s tailored jacket constructed from 100 percent cotton woven fabric. The jacket features cap sleeves, a full front opening secured by three buttons, a notched lapel, two patch pockets below the waist and princess seaming on the front panels. The back of the garment features a rear peplum located in the center below a partial self-fabric belt.

The applicable subheading for style 1BS15R-8066 will be 6204.32.2030, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girls’ suits, ensembles, suit-type jackets, blazersof cotton: other: other: women’s. The duty rate will be 9.4 percent ad valorem.
