RE: The tariff classification of a woman’s shirt from China

Dear Mr. Lynch:

In your letter dated November 16, 2005, you requested a tariff classification ruling on behalf of Susan Bristol Inc. The submitted sample will be returned to you as requested.

Style 1612949 is a woman’s shirt constructed from 97 percent cotton and 3 percent spandex woven fabric. The shirt features long sleeves with snapped cuffs, a collar, two chest pockets with flaps secured by snaps, two pockets at the waist, a banded bottom and a full front opening secured by five snap closures.

The applicable subheading for style 1612949 will be 6211.42.0056, Harmonized Tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of cotton: blouses, shirts and shirt-blouses, sleeveless tank styles and similar upper body garments excluded from heading 6206. The duty rate will be 8.1 percent ad valorem.
